Profile

Cody is a partner in our Litigation Group, and maintains a broad civil and commercial litigation practice. He has a particular focus in construction litigation, commercial and professional negligence, and disputes relating to infrastructure projects. This involves acting for general contractors, subcontractors, public and private owners, and design and building professionals. He also has experience litigating a wide variety of breach of contract, fiduciary duty, and tort claims.   

In addition, Cody has a unique and diverse expertise in insurance law. His practice includes the prosecution and defence of intricate first party coverage claims, with particular focus on property loss, equipment loss, stock loss, business interruption, aviation loss, marine and cargo loss, by-law coverage, builder’s risk, fraud, and arson. He frequently advocates for clients on complicated liability coverage disputes at the claims level and in litigation.

Cody also advises for-profit and not-for-profit organizations on various issues related to their insurance portfolios, particularly in the commercial general, professional, directors and officers, and entity liability context. He regularly prepares indemnity agreements, liability waivers, and implementation policies for these organizations. Cody’s insurance expertise extends to assisting clients in first party claims presentation, as well as the preparation of complex Proofs of Loss.

Cody has successfully argued numerous motions and applications before Judges and Masters of the Ontario Superior Court.
